Terms of Service

1. Acceptance of Terms

By accessing or using WoxomQuote (the "Service"), available at quotes.woxomhealth.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

You must be at least 18 years of age to use this Service. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

2. Description of Service

WoxomQuote is an insurance premium comparison and quoting tool designed for use by licensed insurance agents. The Service provides the following features:

• Premium Quoting -- Agents enter client demographic information to generate and compare insurance plan premiums from multiple carriers and data sources.
• Quote Sharing -- Agents can share quote comparisons with clients via email or shareable links.
• Client Portal -- Clients can request quotes directly from an agent's personalized URL.
• Enrollment -- Clients can begin insurance enrollment applications through the tool.

The Service provides premium estimates based on available data and may differ from actual carrier rates. The Service does not provide insurance advice, recommendations, or endorsements of any particular plan, carrier, or coverage type. All insurance decisions should be made in consultation with a licensed insurance professional.

3. User Accounts and Registration

To access agent features of the Service, you must register using your National Producer Number (NPN). By registering, you represent and warrant that:

• Your NPN is valid and belongs to you.
• You hold valid, active insurance licenses in the states where you generate quotes using the Service.
• All profile information you provide is accurate and current.
• You will promptly update your profile information if it changes.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree to use the Service only for its intended purpose of legitimate insurance quoting and related activities. You must not:

• Submit false, misleading, or fraudulent information.
• Attempt to access, view, or modify another agent's data, quotes, or account.
• Use automated scripts, bots, scrapers, or other programmatic means to access the Service.
• Interfere with or disrupt the Service's infrastructure, security, or availability.
• Use the Service for any unlawful purpose or in violation of applicable insurance regulations.
• Reproduce, redistribute, or publicly display any premium data or rate information obtained from the Service except as part of normal quoting activities with clients.

5. Data Accuracy Disclaimer

Premium quotes generated by the Service are estimates only and are based on the information provided by the user. You acknowledge and agree that:

• Actual premiums may vary based on carrier underwriting, eligibility verification, and other factors not captured by the Service.
• Rate data is updated periodically but may not reflect real-time changes in carrier pricing.
• Subsidy estimates (such as Advanced Premium Tax Credits) are approximations and may differ from amounts determined by the Health Insurance Marketplace.
• Plan availability, benefits, and coverage details may change without notice from the carriers.

Woxom Solutions LLC is not responsible for any discrepancies between quoted premiums and actual premiums charged by insurance carriers.

6. Intellectual Property

The Service, including its design, code, user interface, logos, and all associated intellectual property, is the exclusive property of Woxom Solutions LLC and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the Service without prior written consent from Woxom Solutions LLC.

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WOXOM SOLUTIONS LLC SHALL NOT BE LIABLE FOR:

• Any losses, damages, or claims arising from inaccuracies in premium estimates or rate data.
• Service interruptions, downtime, or unavailability.
• Unauthorized access to or alteration of your data.
• Any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

In no event shall the total liability of Woxom Solutions LLC exceed the amount of fees paid by you for the use of the Service. The Service is currently provided free of charge; accordingly, maximum aggregate liability is zero dollars ($0).

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information. By using the Service, you consent to the data practices described in the Privacy Policy.

9. Indemnification

You agree to indemnify, defend, and hold harmless Woxom Solutions LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.
• Any content or information you submit through the Service.

10. Termination

Woxom Solutions LLC reserves the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, fraudulent activity, or inactivity.

You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including, without limitation, Sections 6, 7, 9, and 12) shall survive.

11. Modifications to Terms

Woxom Solutions LLC reserves the right to update or modify these Terms at any time. When changes are made, we will update the "Last Updated" date at the top of this page and, where practicable, provide notice through the Service.

Your continued use of the Service after the posting of revised Terms constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must discontinue your use of the Service.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Broward County, Florida. You consent to the personal jurisdiction of such courts and waive any objection to venue therein.
